CITY VICTORIOUS IN APPEALS COURT |

Press Release 8/11/09 To The Citizens of Greenwood, Missouri As most of you know, the City has been in a lawsuit with HMM (Hunt Martin Marietta) a.k.a. “the quarry”. It has been a long and tedious quest to rid the community of 900 tractor-trailers carrying gravel, dust and cancer causing diesel fumes through our residential streets. We have lawsuits in both the State Court and the Federal Court. It is my pleasure to report to you today that we, The City of Greenwood, Missouri has won in the State Court of Appeals! What this means is, the unanimous State jury verdict against the quarry in regards to being a public nuisance stood up in the Court of Appeals. It also means The City of Greenwood’s award of 11.9 million dollars stands. The quarry still has the right to take this decision to the Missouri Supreme Court, but as it stands today, Greenwood will be receiving the monetary award of 11.9 million dollars plus interest. I want to personally thank all of the citizens that stood by our side and did not waiver on their opinions. Also, I would like to thank Alderman Jim Payne and former Alderman Mark Dziedzic for their support and continued perseverance to make our community a better place for all citizens.
